At Least One Resident Hospitalized by Legionnaires’ Disease Contamination at The Reserve at Thousand Oaks

Legionnaires' Disease
|

In June 2025, Legionella pneumophila — the bacterium that causes Legionnaires’ disease — water contamination at The Reserve at Thousand Oaks in Ventura County was confirmed by the facility. At least one elderly resident fell severely ill and required hospitalization, where she was diagnosed with Legionnaires’ disease.

Reportedly, several other elderly residents at the assisted living facility were diagnosed with pneumonia, but they might not have been tested specifically for Legionnaires’ disease. Legionnaires’ disease is a type of pneumonia, so it is very possible that multiple residents of The Reserve at Thousand Oaks have already been afflicted by Legionnaires’ disease due to inadequate maintenance of the water supply there.

Now, the 86-year-old woman who was hospitalized and her family are taking legal action with the help of the highly experienced Legionnaires’ disease attorneys of Riley Ersoff to try to set things right. Other residents of The Reserve at Thousand Oaks may also have grounds to start a claim.

Is The Reserve at Thousand Oaks Liable for the Legionnaires’ Disease Outbreak?

The Reserve at Thousand Oaks in Ventura County, as well as its parent company, MBK Senior Living, could be liable for any harm caused to residents by a Legionnaires’ disease outbreak via contaminated or unclean water. Assisted living facilities are contractually obligated to provide safe and clean living conditions for their residents, and any failure to do so could justify legal action, such as an injury claim, lawsuit, or even class action.

Even if The Reserve took prompt and appropriate action after first discovering the Legionella pneumophila contamination, the company and facility can still be strictly liable for any physical and financial harm to its residents caused by the outbreak.

Damages that might be pursuable in legal action taken against The Reserve could include:

  • Past and future medical treatment expenses, including hospitalization
  • Non-economic losses related to pain and suffering
  • Losses caused by a wrongful death (in the event of a fatal case of Legionnaires’ disease)
  • Miscellaneous costs incurred by an affected elderly resident and their family

Who Can File a Legionnaires’ Disease Claim Against The Reserve at Thousand Oaks?

Currently, our Ventura County Legionnaires’ disease attorneys of Riley Ersoff are helping our client explore her legal options and prepare to file a claim against The Reserve at Thousand Oaks. We argue that the assisted living facility failed to take proper steps to protect her from the risk of Legionnaires’ disease and other pneumonia-related illnesses, and so, she and her family deserve justice and financial compensation.

However, due to reports of multiple other residents who were diagnosed with pneumonia – and the fact that Legionnaires’ disease is medically considered a form of pneumonia – we believe that there may be many other elderly residents at The Reserve who have valid injury claims to file.

An elderly resident of The Reserve at Thousand Oaks could have grounds to start legal action with the help of Riley Ersoff if:

  • They were diagnosed with Legionnaires’ disease;
  • They were diagnosed with any form of pneumonia; or,
  • They were severely ill around the time of the Legionnaires’ disease outbreak (first confirmed in June 2025) but were not given a diagnosis.

You can also speak to our attorneys if you lost a loved one to a severe illness recently at The Reserve at Thousand Oaks. It’s possible that Legionella bacteria caused their illness, and that you could have the option to start a wrongful death claim.
