In securing this ground-breaking $3,000,000 settlement, Victoria and Riley | Ersoff LLP filed a complaint in the Los Angeles Superior Court alleging that the defendant landlord repeatedly ignored plaintiffs' complaints that their apartments were plagued by cockroach and rodent infestations, water leaks, and mold.
Making clear that defendants could care less about the health and safety of the firm's clients, management not only ignored plaintiffs but ignored their contractor's recommendations to temporarily relocate plaintiffs and their young children during construction. As a result, both families were forced to eat, sleep, and live through the demolition of their apartments which included the removal of plaintiffs' furniture, moldy dry wall, and ceiling materials down to the studs.
Defendants actions epitomized what it means to be a heartless and uncaring landlord. Defendants thumbed their noses at the implied warranty of habitability, they were grossly negligent, and repeatedly violated the Los Angeles Tenant Anti-Harassment Ordinance ("TAHO"). In October, 2024, the City of Los Angeles amended TAHO to allow tenants to recover treble damages. The TAHO ordinance prohibits landlord from engaging in bad faith conduct including the failure to perform necessary repairs, delaying repairs, reducing or threatening to reduce services, abusing the right of access, attempting to coerce a tenant to vacate, and other egregious or bad faith conduct.
